    1. Introduction and Definitions

    • Agreement: These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Rideus Private Limited ("Rideus," "we," "us," or "our"), a vehicle rental service provider operating in India.
    • Business Model: Rideus operates as a self-drive vehicle rental platform connecting customers with rental vehicles for tourism and personal transportation purposes.
    • User/Customer: The terms "User," "Customer," "You," and "Your" refer to the individual or entity that accesses our services, website, mobile application, or rents vehicles through Rideus.
    • Platform: The term "Platform" refers to our website , mobile applications, and any other digital interfaces owned and operated by Rideus.
    • Services: The term "Services" refers to the vehicle rental services, including cars and other vehicles, offered by Rideus through its Platform.
    • Acceptance and Binding Agreement: By accessing or using the Rideus platform, creating an account, or booking a vehicle with us, you expressly acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. This constitutes a legally binding agreement between you and Rideus. If you do not agree with any part of these Terms, you must not use our services or Platform.
    • Legal Compliance: These Terms comply with applicable Indian laws including the Indian Contract Act, 1872, the Consumer Protection Act, 2019, the Information Technology Act, 2000, and the Motor Vehicles Act, 1988 (as amended).

    2. Eligibility Criteria

    • Age Requirement:
      • Minimum 21 years for regular vehicles.
      • Minimum 24 years for premium range vehicles (BMW, Audi, Mercedes, Endeavour, Fortuner, etc.)
    • Valid License: You must possess a valid driving license that authorizes you to operate the specific type of vehicle you wish to rent, in compliance with Section 3 of the Motor Vehicles Act, 1988. Learner's licenses are not accepted.
    • License Validity: Your driving license must remain valid throughout the entire rental period as per the Central Motor Vehicle Rules, 1989.
    • Identity Verification: You must provide valid identity and address proof documents as specified in Section 3 below.
    • Rideus' Right to Refuse: Rideus reserves the right to refuse service to anyone who does not meet our eligibility criteria or for any other lawful reason.

    3. Required Documentation

    • Mandatory Documents:
      • Valid Driving License issued by competent authority.
      • Aadhaar Card or other government-issued photo ID
    • Additional Requirements for Local Residents:
      • Students must carry College/Institution ID card for address proof.
      • Employed individuals must carry Job/Company ID for address proof
      • Without valid Job/College ID, no local resident is eligible to rent vehicles
    • Document Verification:
      • Email your driving license, Aadhaar card copy, and live photograph to support@rideus.in for pre-verification.
      • All documents are subject to verification at the time of pickup
      • Failure to provide valid/required documents will result in booking cancellation and Rs. 500/- deduction plus applicable cancellation charges

    4. Booking and Payment Terms

    • Booking Process: Bookings can be made through our Platform, subject to vehicle availability and successful verification of documents.
    • Booking Confirmation: A booking is confirmed only after payment of the specified amount and successful document verification.
    • Payment Methods: We accept various payment methods including cash, digital payments (Paytm, GPay, PhonePe), and card payments, in compliance with RBI guidelines.
    • Transparent Pricing: All charges including rental fees, security deposits, taxes, and additional services will be clearly disclosed. There are no hidden charges.
    • Security Deposit:
      • ₹2,000 for Hatchback/Sedan
      • ₹3,000 for SUV
      • ₹10,000 for Premium vehicles

    5. Cancellation Policy

    • Cancellation Charges:
      • Cancellation before 24 hours of pickup time: Rs. 500/- deduction from total amount.
      • Cancellation within 24 hours of pickup time: 50% refund of total rental amount.
      • Failure to provide valid/required documents will result in booking cancellation and Rs. 500/-. ⁠Cancellation within 6 hours of pickup time: Non-Refundable.
      • Vehicle change/swapping: Rs. 500/- deduction.
    • No-Show Policy: If customer doesn't pick up vehicle within 6 hours of scheduled pickup time without prior information: Booking treated as cancelled with Rs. 1,500/- deduction.
    • Refund Processing: Cancellation refunds will be processed within 7 working days from the date of cancellation.
    • Company Cancellation: Rideus may terminate any booking at any time without prior notice at its sole discretion.

    6. Vehicle Usage Terms and Restrictions

    • Purpose Limitation: Vehicles can only be rented for tourism purposes and personal transportation within the permitted geographical boundaries.
    • Authorized Drivers: Only the person named in the rental agreement is authorized to drive the vehicle. Subletting or allowing unauthorized persons to drive will result in forfeiture of security deposit.
    • Geographical Restrictions (Prohibited Regions): Travel to the following districts is strictly prohibited and will incur a penalty of Rs. 5,000/- with no roadside assistance
      • Malkangiri
      • Phulbani
      • Koraput
      • Similipal
    • Geographical Restrictions (Outside Odisha Travel):
      • Must inform in advance before booking
      • 24-hour bookings: Limited to 300 KMs one-way from pickup location
      • 12-hour bookings: Limited to 150 KMs one-way from pickup location
    • Prohibited Uses: The vehicle shall NOT be used for:
      • Carrying arms, ammunition, banned drugs, or mortgaging
      • Commercial activities such as product sales, promotion, or goods transportation (Penalty: Rs. 10,000 plus legal charges)
      • Speed racing or competitions
      • Towing, pushing, or propelling trailers or other vehicles
      • Operating as a taxi service or commercial transportation
      • ⁠Any illegal activities or commission of crimes
      • Under the influence of alcohol or drugs
    • Vehicle Condition Restrictions:
      • Smoking, drinking, pets, and drug use inside vehicles is strictly prohibited (Penalty: Rs. 2,000)
      • Vehicle must be returned clean and in the same condition as provided
    • Speed Limitations:
      • Exceeding 80 kmph: Rs. 200/- penalty per instance
      • Multiple speed violations: Additional Rs. 500/- penalty

    7. Rental Duration and Kilometer Policy

    7.1 Kilometer Allowance:

    • Unlimited kilometers for bookings of 24 hours and above (normal range vehicles only)
    • Specific kilometer restrictions apply for shorter duration bookings

    7.2 Late Return Charges:

    • Hatchbacks: ₹150 per hour
    • Sedans: ₹200 per hour
    • SUVs: ₹250 per hour

    7.3 Extension Policy:

    • Extensions subject to vehicle availability
    • Must be requested before the original drop-off time
    • Additional charges apply at prevailing rates

    8. Fuel and Maintenance Policy

  1. Fuel Responsibility:
    • Customer is responsible for fuel costs
    • Vehicle must be returned with the same fuel level as provided at pickup
    • Refueling charges and Fastag recharges are non-reimbursable

    8.2 Mechanical Issues:

    • If mechanical faults occur during rental period, Rideus will arrange alternate transportation at no additional cost
    • Customer is not responsible for mechanical failures not caused by misuse

    9. Damage and Insurance Policy

    9.1 Customer Liability:

    • Normal range vehicles: Customer liable for damages up to ₹25,000
    • Premium range vehicles: Customer liable for damages up to ₹75,000

    9.2 Insurance Coverage:

    • Insurance claims applicable for damages exceeding the above thresholds
    • Customer must bear rental charges for idle period during repair based on booking price
    • Customer responsible for any excess charges beyond insurance claim amount

    9.3 Accident Procedures:

    • Immediately inform local police and Rideus customer support
    • Obtain necessary police reports and documentation
    • Cooperate fully with insurance procedures

    10. Vehicle Tracking and Security

    10.1 Tracking Systems: Vehicles may be equipped with advanced telematics for security and operational purposes.

    10.2 Tampering Prohibition: Any tampering with mechanical, electrical, or telematics systems will result in:

    • ₹10,000 penalty
    • Potential legal action
    • Forfeiture of security deposit

    11. Roadside Assistance

    11.1 Assistance Scope: Rideus provides reasonable roadside assistance support in most cases during the rental period.

    11.2 Customer Responsibility: If roadside assistance is required due to customer's breach of terms and conditions, full service costs will be charged to the customer.

    12. Delivery and Pickup Services

    • 12.1 Airport Delivery:
      • Free airport delivery service
      • Toll charges are additional and payable by customer
    • 12.2 Home Delivery:
      • Free pickup and drop within 10 KM radius of service location
      • Additional charges apply for delivery/pickup beyond 10 KM radius

    13. Working Hours and Support

    • 13.1 Operational Hours: 6:00 AM to 11:00 PM, all days of the week
    • 13.2 Customer Support:

      • Response time during working hours: Immediate to 2 hours
      • Outside working hours: Email support available, response during next working hours

    14. Data Protection and Privacy

    • 14.1 Data Collection: Rideus collects personal information including identification documents, contact details, and vehicle usage data in compliance with applicable privacy laws.
    • 14.2 Data Usage:
      • Vehicle rental services and customer verification
      • Security and tracking purposes
      • Communication regarding bookings and services
      • Compliance with legal requirements
    • 14.3 Data Security: Rideus implements reasonable security measures to protect customer data but cannot guarantee absolute security.

    15. Penalties and Additional Charges

    • 15.1 Traffic Violations: All fines, penalties, and legal costs arising from traffic violations are customer's responsibility.
    • 15.2 Specific Penalties:
      • Speed violations: Rs. 200/- per instance, Rs. 500/- for multiple violations
      • Prohibited substance use in vehicle: ₹2,000
      • Unauthorized driver usage: Security deposit forfeiture
      • Prohibited region travel: ₹5,000
      • Commercial use: ₹10,000 plus legal charges
      • Telematics tampering: ₹10,000 plus legal action

    16. Security Deposit Management

    • 16.1 Deposit Refund: Security deposits will be refunded within 24 hours of trip completion in the same mode of payment, subject to:
      • Satisfactory vehicle return condition
      • No violations of terms and conditions
      • No pending penalties or damages
    • 16.2 Deposit Adjustment: Security deposits may be adjusted against any penalties, damages, or outstanding charges before refund.

    17. Limitation of Liability

    • 17.1 Customer Risk: Customer agrees that use of Rideus services is at their sole risk.
    • 17.2 Company Liability: Rideus' liability is limited to the fullest extent permitted by law.
    • 17.3 Force Majeure: Rideus is not liable for delays or failures due to circumstances beyond its control including natural disasters, government actions, or other force majeure events.

    18. Dispute Resolution

    • 18.1 Amicable Resolution: Parties will first attempt to resolve disputes through good faith negotiations.
    • 18.2 Jurisdiction: Any legal disputes will be subject to the jurisdiction of courts in Bhubaneswar, Odisha, India.
    • 18.3 Arbitration: If specified in the booking agreement, disputes may be resolved through arbitration in accordance with Indian Arbitration laws.

    19. Consumer Rights

    • 19.1 Consumer Protection: Nothing in these terms limits statutory consumer rights under the Consumer Protection Act, 2019.
    • 19.2 Complaint Resolution: Customers may approach appropriate consumer forums for unresolved disputes as per applicable law.

    20. Modification of Terms

    • 20.1 Right to Modify: Rideus reserves the right to modify these terms with reasonable notice to customers.
    • 20.2 Continued Use: Continued use of services after modification constitutes acceptance of updated terms.

    21. Termination

    • 21.1 Customer Termination: Customers may terminate by completing rental and returning vehicle as scheduled.
    • 21.2 Company Termination: Rideus may terminate service immediately for:
      • Violation of terms and conditions
      • Providing false information
      • Illegal activities or safety concerns
      • Non-payment of dues

    22. Severability

    • 22.1 Invalid Provisions: If any provision is deemed invalid, the remaining terms continue in full force and effect.
    • 22.2 Entire Agreement: These terms constitute the complete agreement between parties regarding vehicle rental services.
